Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Voyacar platform operated by Voyacar, Inc. (Delaware, USA). Please read them carefully. By creating an account, making a booking, or otherwise using the platform, you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. Definitions

In these Terms:

  • “Platform”, “we”, “us”, “Voyacar” means the website, applications and booking services operated by Voyacar, Inc..
  • “Agency” means an independent car or motorcycle rental company that lists vehicles and concludes the rental with you.
  • “Client”, “you” means any person who uses the Platform or makes a booking.
  • “Booking” means a reservation request you place through the Platform and that is confirmed to you.
  • “Rental Agreement” means the separate contract you sign with the Agency at pick-up, which governs the rental itself.
  • “Service Fee” means the amount you pay to Voyacar online at the time of booking (our commission for the intermediation service).
  • “Balance” means the rental price payable directly to the Agency, normally at pick-up.
  • “Security Deposit” (also called franchise or excess) means the amount the Agency may block or hold on your payment card to cover damage, fuel or other rental obligations.

2. Our role — an intermediary, not the rental company

Voyacar is a booking intermediary. We operate a marketplace that connects you with independent Agencies. We do not own, operate or maintain any vehicle fleet and we do not rent vehicles ourselves.

Your booking creates two distinct relationships: (a) a booking contract between you and Voyacar, governed by these Terms; and (b) a Rental Agreement between you and the Agency, governed by the Agency’s own conditions and the Rental Agreement you sign at pick-up. The Agency — not Voyacar — is the lessor and the party responsible for providing the vehicle and the rental.

Vehicle descriptions, prices, availability and rental conditions shown on the Platform are provided by the Agencies for information. Where the Agency’s conditions presented at the counter differ from those shown on the Platform, the Agency’s Rental Agreement prevails for the rental itself. We encourage you to read the Agency’s conditions before you book and before you sign.

3. Eligibility and your account

You must be at least 18 years old to use the Platform and to make a booking. The minimum driving age and the minimum period for which a licence must have been held are set by each Agency and may be higher.

You agree to provide accurate, current and complete information and to keep it up to date. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us promptly of any unauthorised use.

We may refuse, suspend or close an account, or cancel a booking, where we reasonably suspect fraud, abuse, a breach of these Terms, or a risk to other users or Agencies.

4. Making a booking

When you place a booking, you make an offer to reserve the selected vehicle for the dates and pick-up location shown. The booking is formed when we send you a confirmation. The confirmation, together with these Terms and the information shown at booking, sets out what you have reserved.

A booking is confirmed by the Agency. An Agency may require a minimum advance notice (lead time) before pick-up; vehicles that cannot meet your requested pick-up time are not offered to you. In the rare event a confirmed vehicle becomes unavailable, we will offer a comparable alternative or a refund of the Service Fee.

You are responsible for entering correct trip details (dates, times, pick-up city, driver information). A booking is personal to the named driver.

5. Price and payment

The total price shown is made up of the Agency’s rental price plus the Voyacar Service Fee, and includes applicable taxes unless stated otherwise.

Payment is split. At the time of booking you pay the Service Fee online to Voyacar through our payment provider, Stripe. The Balance (the rental price) is payable directly to the Agency, normally at pick-up, by the means the Agency accepts. Local extras you select or add at the counter (for example additional driver, child seat, out-of-hours pick-up, one-way fee, extension) are priced and charged by the Agency, not by Voyacar.

We do not store your full card details; card data is processed by Stripe. Where you pay in a currency other than the Agency’s, your card issuer’s exchange rate and fees apply and are outside our control.

Prices may change until your booking is confirmed. Obvious pricing errors (for example a clearly mistaken amount) are not binding on us; if one occurs we will let you cancel without charge or confirm the correct price.

6. The rental, driver documents and conditions

The rental is governed by the Rental Agreement between you and the Agency. The Agency is responsible for the vehicle’s condition, roadworthiness, insurance, registration and legal compliance, and for the conduct of the rental.

At pick-up the Agency will normally require, for the main driver: a valid driving licence held for the period the Agency requires; a passport or national ID; and, in most cases, a credit card in the main driver’s name with sufficient available funds for the Security Deposit. An International Driving Permit may be required. Requirements vary by Agency and country; it is your responsibility to check and meet them.

The Agency may refuse to hand over the vehicle (a “counter refusal”) where you do not meet its conditions — for example missing or invalid documents, an ineligible driver, signs of intoxication, or insufficient funds for the Security Deposit. In that case the rental does not start and the rules in Section 7 apply.

7. Changes, cancellation, refunds and no-show

Free cancellation window. You may cancel free of charge up to 48 hours before the scheduled pick-up time; in that case the Service Fee you paid online is refunded. This free-cancellation window is a contractual benefit offered by Voyacar and is separate from any statutory right you may have.

Late cancellation and no-show. If you cancel less than 48 hours before pick-up, or you do not show up, the Service Fee is non-refundable. If the Agency refuses to hand over the vehicle because you did not meet its conditions (Section 6), this is treated as a no-show and the Service Fee is non-refundable. If you are turned away at the counter, contact us immediately so we can record what happened.

The Balance and Agency charges. Any refund of the Balance, and any cancellation, amendment or no-show fee charged by the Agency, are governed by the Agency’s own conditions. We will help you raise the matter with the Agency but we do not control those amounts.

Amendments. You may request changes to a booking subject to availability and the Agency’s conditions; price differences may apply. No refund is due for unused time once the rental has started.

8. Security deposit and franchise

The Security Deposit (and any insurance excess or franchise) is set, blocked, held, applied and released by the Agency under the Rental Agreement. Voyacar does not collect, hold or control the Security Deposit and is not responsible for blocking, withholding, deducting or releasing it.

You must present a valid payment card in the main driver’s name with sufficient funds. Release timing after the rental depends on the Agency and your card issuer and can take from several days to a few weeks.

9. During the rental

Fuel, mileage limits, tolls, congestion charges, parking, traffic or administrative fines, cross-border travel, additional drivers, damage, theft and accidents are matters between you and the Agency under the Rental Agreement. Charges may apply and may be deducted from the Security Deposit in accordance with the Agency’s conditions.

In the event of accident, theft or damage you must follow the Agency’s instructions, notify the Agency without delay and, where required, file a police report. You remain responsible for fines and for the lawful use of the vehicle. Voyacar is not a party to these matters.

10. Reviews and user content

You may submit reviews and other content only in relation to a genuine, completed booking. Your content must be accurate, lawful and respectful, and must not be misleading, defamatory, infringing or harmful.

You keep ownership of your content and grant Voyacar a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to host, use, reproduce, translate, adapt, publish and display it in connection with the Platform and its promotion. You are responsible for the content you submit.

We may moderate, decline, edit for length, withhold or remove content — including to prevent fraud, manipulation, spam or breaches of these Terms — and we may suspend the ability to post.

11. Acceptable use

You agree not to:

  • use the Platform for any unlawful, fraudulent or harmful purpose, or make speculative, false or nuisance bookings;
  • scrape, crawl, harvest, index or copy data, prices or content, or place excessive load on, probe or interfere with the Platform or its security;
  • circumvent fees, impersonate others, or provide false identity, licence or payment information;
  • use a booked vehicle for ride-hailing, chauffeur, sub-rental or other commercial carriage without the Agency’s authorisation; or
  • infringe our or any third party’s intellectual property or other rights.

12. Intellectual property

The Platform and its content, software, trademarks, logos and design are owned by Voyacar, Inc. or its licensors and are protected by law. We grant you a limited, personal, non-transferable, revocable licence to use the Platform for its intended purpose. No other rights are granted.

13. Complaints and claims

If something goes wrong, raise it first with the Agency and contact our support at [email protected] with your booking reference and any supporting documents. Departure and return inspection reports, photos and messages exchanged through the Platform may be used to help resolve a dispute.

We will use reasonable efforts to help mediate between you and the Agency, but we are not obliged to provide arbitration and we cannot decide matters that fall under the Rental Agreement. Please raise claims promptly; claims raised long after the rental ends may be harder to resolve.

14. Liability

Voyacar provides the booking platform with reasonable care and skill, but we do not provide the rental and we do not guarantee the acts, omissions, vehicles or services of any Agency. To the maximum extent permitted by law, we are not liable for the performance of the Rental Agreement or for loss arising from it.

To the maximum extent permitted by law, our total liability to you in connection with a booking is limited to the amount of the Service Fee you paid to Voyacar for that booking. We are not liable for indirect or consequential loss.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded — including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for our gross negligence or wilful misconduct. Mandatory consumer-protection rules that apply to you override anything in these Terms that conflicts with them.

15. Personal data

We process personal data as described in our Privacy Policy. When you book, we share the data the Agency needs to provide the rental; the Agency then acts as an independent controller of that data under its own privacy policy. Please review our Privacy Policy for full details.

16. Events beyond our control

We are not responsible for any failure or delay caused by events beyond our reasonable control, including natural events, extreme weather, epidemics, strikes, war, civil unrest, governmental measures, or failures of networks, payment systems or third-party providers. Where such an event affects your booking, any refund depends on the Agency’s conditions and on what we have already collected.

17. Changes to these Terms

We may update these Terms from time to time. The version in force when your booking is confirmed continues to apply to that booking. We will post the updated Terms with a new “last updated” date and, where the change is material, take reasonable steps to notify you. Your continued use after the change takes effect means you accept the updated Terms.

18. Suspension and termination

You may stop using the Platform at any time and may close your account. We may suspend or terminate your access, or cancel a booking, for breach of these Terms, suspected fraud or unlawful conduct, or to protect users, Agencies or the Platform. Provisions that by their nature should survive termination (including liability, intellectual property and governing law) continue to apply.

19. Governing law and disputes

These Terms are governed by the laws of the Delaware, USA, without regard to conflict-of-laws rules, and the state or federal courts located in Delaware, USA have jurisdiction — except that this does not deprive you of the protection of the mandatory consumer-protection rules of the country where you live.

If you are a consumer in the European Union, you keep the protection of the mandatory provisions of your country of residence and may bring proceedings in your local courts; the European Commission’s Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr. If you are a consumer in Morocco, the mandatory provisions of Moroccan consumer law (including Law 31-08) continue to apply to you.

20. General

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions stay in full force. Our failure to enforce a provision is not a waiver of it. You may not assign your rights without our consent; we may assign or transfer ours to an affiliate or successor.

These Terms are available in several languages for your convenience. The English version is the reference version; where mandatory law requires the local-language version to prevail for you as a consumer, it does.
